# Terms of Service

## **1) Scope**

These Terms govern your personal, non-commercial use of the Flowvi.be app. They are subject to **Belgian law** and applicable **EU consumer legislation**. If you are a consumer in the EU, you also enjoy the protection of the mandatory laws of your country of residence.

## **2) License and acceptable use**

We grant you a non-exclusive, non-transferable, revocable license to use the app in accordance with these Terms and applicable law. You agree not to:

- reverse-engineer, decompile, or bypass security;

- use the app in a way that burdens or disrupts it;

- infringe third-party rights or violate the law;

- commercialize the app or content without our written consent.

## **3) Third-party services (Apple Music, iCloud, others)**

If you connect Apple Music or other in-app integrations, their terms and privacy policies apply and they act as **independent controllers** for their processing.

If you enable **iCloud**, on-device data may sync to your iCloud account under **Apple's** terms/policies. We are not responsible for third-party content, storage locations, or service availability.

## **4) Subscriptions, trials, and billing (App Store)**

Purchases, billing, renewals, and cancellations are handled by the **Apple App Store**. Manage your subscription in your **Apple ID settings**. Refunds are handled under Apple's policies; **we will assist you** in contacting Apple where appropriate.

## **5) EU consumer rights (Directive 2019/770)**

If the app does not conform to what was promised, you may request that we bring it into conformity. If defects persist, you may be entitled to a **price reduction or refund**. Nothing in these Terms affects your **statutory consumer rights**.

## **6) Right of withdrawal (digital content)**

You have a **14-day** right of withdrawal from digital purchases unless you request immediate performance, in which case you acknowledge losing that right once delivery begins. The withdrawal and refund process is administered by **Apple**.

## **7) Intellectual property**

All IP in the app (excluding third-party content) belongs to Headbright Group or our licensors. No rights are granted except as expressly stated.

## **8) Availability, changes, and updates**

We may add or remove features or impose reasonable limits. We may provide updates for functionality, security, or legal compliance, and may require installing updates to continue using certain features.

## **9) Warranties and disclaimers**

We provide the app using reasonable skill and care. Nevertheless, the app is provided **"as is"** and **"as available"** and we do not warrant uninterrupted or error-free operation. Your **statutory consumer rights** remain unaffected.

## **10) Limitation of liability (consumer-compliant)**

To the maximum extent permitted by law, we are not liable for:

(a) indirect or consequential losses not reasonably foreseeable by both parties;

(b) loss of data that you could reasonably prevent (e.g., via backups or iCloud settings);

(c) outages or failures of third-party services outside our control (e.g., Apple Music, iCloud).

We **do not exclude or limit liability** where unlawful, including for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for gross misconduct. Your mandatory rights under Belgian/EU law remain unaffected.

## **11) Security & updates (EU CRA - minimum)**

- We maintain proportionate security measures consistent with EU standards.

- We provide updates and security patches for a **reasonable period** to keep the app safe and compliant.

## **12) Termination**

You may stop using the app at any time. We may suspend or terminate access for material breaches (e.g., abuse, unlawful use) with proportionate measures and, where reasonable, prior notice.

## **13) Governing law & disputes**

These Terms are governed by **Belgian law**. Disputes may be brought before the **courts of Ghent**, **without prejudice to EU consumer forum rights** that allow you to bring claims in your country of residence. EU consumers may also use official ADR/ODR mechanisms.

## **14) Discontinuation**

If we discontinue the app, subscriptions will stop renewing. Any refunds for unused periods are handled in accordance with **Apple's App Store policies**.
